These general conditions of sale (hereinafter “GTC”) are applicable exclusively to the online sale of products from the company livredeschallenges, on the website www.livredeschallenges.fr.
These General Conditions of Sale are exclusively applicable to products delivered to customers established in France.
The T&Cs are made available to customers on this site, where they can be directly consulted.
We recommend that you take the time to read the T&Cs as they govern the contractual relationship related to your use of our site and the services offered there. By ticking the box provided for this purpose, you indicate that you have read our General Conditions of Sale and accept them.
Any order made on the website requires that the customer accepts beforehand and without reservation the GTC as a whole. In case of disagreement with the terms and conditions of the GCS, the customer must not use the website.
Only legal persons capable of entering into contracts concerning the products offered for sale on the website can place an order on the website. When placing the order, the customer guarantees to have full legal capacity to adhere to the General Conditions of Sale, place an order and conclude the sale.

The terms and expressions identified by a capital letter in these General Conditions of Sale have the meaning indicated below (whether they are used in the singular or in the plural):
“General Terms and Conditions of Sale or GTC”: refers to this document,
"Order": refers to the customer's purchase order relating to one or more product(s) placed by use of the website,
“Website”: refers to the website accessible at the address www.livredeschallenges.fr
“Product”: refers to a product offered for sale on the website,
“Customer”: refers to a natural person who is an adult consumer who uses the website and acquires one or more product(s), for his personal needs, through the website, having previously adhered to the General Conditions of Sale.
2. DESCRIPTION OF PRODUCTS
The products for sale on the site each have a descriptive sheet dedicated to them. This sheet includes several elements that most faithfully represent the product: photographs, descriptions of technical data, technological data provided by suppliers, manufacturers and any other professional who has worked on the manufacture of the product.
Before placing an order, we invite you to carefully study the description and characteristics of the product.
Some products will be sent as a kit, and you will have to assemble them yourself.
We have adopted a policy of continuous product development in order to bring you what we consider to be the best in design at the best price. We therefore reserve the right to modify prices, packaging and specifications as well as any service related to the products, at any time and without notice.
3. PRICE
3.1 The prices are indicated in euros (€), all taxes included (TTC), any possible tax applicable in your name on your behalf at the time of customs clearance of the products is the responsibility of the customer.
Payment is made in euros (€).
3.2 The price does not include the costs of delivery, transport to your home or to a relay point or any additional costs whatsoever. The customer will be aware of the additional costs on the purchase summary page before payment, as well as on the order confirmation once the price has been paid.
3.3 In the event of a promotion, the site displays the sale price, the price before reduction and the price of the savings made. In this case, the only price having contractual value is the sale price. The others are provided for information only.
3.4 We reserve the right to modify the prices at any time, while guaranteeing you the application of the price in force on the day of the order.
3.5 For your information, our site also mentions, for certain products, price comparisons with equivalent products offered by other distributors. Our comparisons are based on the reference prices observed on the market for products deemed to be identical or directly comparable to those we offer. However, these are only estimates and may vary and have no contractual value.

4. OFFER
The online sales offers presented on the site are reserved for customers residing in Europe for deliveries in these same geographical areas.
The online sales offers presented on the site are valid, in the absence of indication of a particular duration, as long as the products appear in the electronic catalog.
The offers are not cumulative and are valid only once per user.
The acceptance of the offer by the customer is validated, in accordance with the double click process, by the confirmation of the order.
5. PURCHASE OF PRODUCTS/ORDER
5.1 Order Steps
Orders are placed and received only via the Internet and processed by the company .
To place an order, you must, after having filled your virtual basket, indicating the selected products and the desired quantities.
The customer validates his order as stated below. This validation entails the acceptance of these general conditions of sale. The customer interested in an article visible on the site follows the following process in order to establish his order. After clicking on the "confirm" icon and after having checked the specifics of his order (color, quantity, price, etc.), the customer validates the choice of the product(s) selected by clicking or can return to previous pages to make any changes in accordance with article 1369-5 of the Civil Code. If the customer benefits from a special offer, he must first enter a code that will have been assigned to him in the field provided for this purpose. When placing their first order, the customer has to fill out a form containing the following information: title, surname, first name, full delivery address, email, date of birth, telephone number. On this occasion the customer creates his password. The customer has the option of paying by credit card directly on the site. After having validated his method of payment, the customer definitively and irrevocably validates his order with the effects indicated below.
5.2 Payment methods
Payment is made in full when ordering. Confirmation of the order entails acceptance of the GCS and formation of the contract.
An e-mail acknowledging receipt of the order and its payment is sent by the Company as soon as possible.
Any Product forming part of the same order that does not appear in the order confirmation email that we have sent to you is not part of this contract.
Before placing an order on our site, it is your responsibility to check and determine your full capacity to receive the products and in particular to ensure that the product ordered can be delivered to your address without incident. It is therefore your responsibility to check the dimensions of the parts of the passages, stairs and other doors and to ensure that the delivery can be made without further specifications.
All the information required on the page before validation of the order must be filled in precisely and accurately. We cannot be held responsible for a delay in delivery due to an error in the delivery address or telephone number. Any additional fees or costs related to complications or delays in delivery will therefore be added to the invoice for your order.
5 . 3 Modification of the Order
Any modification (and in particular modification of the delivery address, spelling of a name, your telephone number or any other particular information) of your order after confirmation of the latter by our services, is subject to our acceptance.
We will then let you know if it is possible and what the changes and additional costs will be.
5.4 Validation of the Order
We reserve the right to refuse any order for legitimate reasons and, more particularly, if the quantities of Products ordered are abnormally high for buyers with consumer status or in the event of a payment problem.
We reserve the right to request any additional document proving your identity that we deem necessary.
We also reserve the right to refuse any order in the event that the price displayed (and paid by the Customer) is inaccurate or derisory due to a technical or computer malfunction.
5.5 Order Cancellation
We remind you that, if you wish to cancel your order, you have (in application of article L.121-20 of the Consumer Code) a withdrawal period of 14 calendar days (Sundays and public holidays included) from receipt of the order, to request the return of the products.
You must then inform our customer service, within 14 calendar days (Sundays and public holidays included) of receipt of the products, by sending an email to the following email address: contact@livredeschallenges.fr.
Once received, the Products will be inspected and our customer service will contact you.
The order will be fully refunded including delivery costs (based on the standard delivery method) with the exception of return costs.
Returned products must reach us in perfect condition. In particular, you must return them in their original packaging, clean and intact or in packaging of sufficient quality to allow them to be transported to our warehouses without damage. Products must not have been used or assembled in any way. Returns will not be accepted once assembly has begun.
The Company reserves the right to refuse a refund for any product deemed unsuitable for resale. (custom product)
After receiving your email, we will contact our carrier to organize the return of the product. The carrier will then contact you quickly to set a possible collection date. In case of return, the following return costs will be charged to you.
If your order has already been delivered to the carrier, return costs will be applied.
We cannot be held responsible for any loss or damage to products that may occur during transport to our warehouses. In this case, the delivery costs will not be refunded to you.
The risks associated with the return of the products will be borne by the Company.
6. DELIVERY
We deliver anywhere in Europe to the exclusion of any other territory.
Delivery costs vary depending on the place of delivery. Additional charges may be added to the order for any scheduled delivery to an isolated or difficult to access location that requires special attention. The costs which are calculated according to the delivery address will be indicated on the summary page before payment of the order.
The delivery address designated by the customer may be different from the billing address.
6.1. delivery time
The delivery time may vary depending on the Products ordered, the quantity of orders and the availability of transport vessels.
Our mode of operation on demand brings this time to a shipment in 48 hours on average. This is an average, sometimes the delay is longer or conversely much shorter. All time estimates given at the time of validation and confirmation of the order are subject to change. If the delivery time changes, we will do our best to contact you and inform you of any changes. In any case, the products will be delivered to you within 5 working days (Saturday and Sunday excluded) from the validation of the order, unless a longer period is indicated when confirming the order.
6.2 Order tracking
livredeschallenges.fr also offers its customers an online tracking tool that allows them to track the progress of their order. We strive to make this tool as accurate as possible using the information available to us.
6.3 Withdrawal of products in case of absence
In the event of the recipient's absence at the time of delivery, the carrier will leave a transit advice note at the delivery address indicated by the customer. The products must then be recovered or withdrawn from the address and according to the methods indicated by the carrier.
In the absence of withdrawal within the deadlines set by the carrier, the products will be returned to the Company, which reserves the right to reimburse the price to the customer, the shipping costs remaining the responsibility of the customer.
6.4 Product compliance
We invite you to open and check your order on the day of its delivery and to inform us immediately of any possible damage suffered during transport. You must ensure that all products and components of a product have not suffered any damage before proceeding with their assembly. It is your responsibility to check that the products delivered reach you in perfect condition before signing the delivery note.
In the event of delivery of an item that does not comply with your order, is damaged or erroneous, we invite you to contact us as soon as possible after delivery, to agree on a refund or replacement.
We may ask you to provide us with a photo of the damaged parts for our records and to enable us to take appropriate action.
Returned products must be sent back to us in their original packaging or in equivalent packaging.
7. CUSTOMS CLEARANCE
By placing your order on our site, you expressly mandate the company to carry out or have carried out, in your name and on your behalf, any customs clearance operations induced by your purchase and all the formalities relating thereto with the customs services in including the payment of duties and taxes and, where applicable, any requests for reimbursement of duties and taxes (for, in particular, returned goods). For Switzerland, customs clearance costs are the responsibility of the customer according to the policy in the country.
8. PAYMENT

A credit card and related information is required to process payment. Payment for any Order must be made only using a credit card issued by one of the companies listed on the purchase page. You certify to us, when paying, that you are the holder of the bank card and that you have sufficient funds to pay for the Order.
The payment of the Order by the Customer is irrevocable, subject to the right of withdrawal.
The sale will then be subject to processing as soon as you click on the “Confirm Order” button. You will receive an email from us confirming the sale, the availability of the Product and the expected average delivery date.
We reserve the right to refuse to process a transaction for any reason or to refuse service to anyone at any time in our sole discretion.
We shall not be liable to you or any third party for refusing to process a transaction or for suspending any transaction after processing has begun.

9. WARRANTIES
9.1 Legal guarantee
All products supplied by the Company benefit from the legal guarantee of conformity provided for by articles L217.4 to L217.14 of the Consumer Code, L.217-17 of the Consumer Code and the legal guarantee against hidden defects provided for in articles 1641 to 1649 of the Civil Code.
Under these guarantees, the professional seller undertakes, at the customer's choice, to reimburse or exchange defective products or products that do not correspond to their order within a period of 2 years from delivery.
The warranty does not cover damage, breakage or malfunctions resulting from non-compliance with the precautions for use.
The customer is reminded that
When acting as a legal guarantee of conformity, the consumer: - has a period of two years from the delivery of the goods to act; - can choose between repairing or replacing the goods, subject to the cost conditions provided for by Article L. 217-9 of the Consumer Code;-is exempted from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods. The legal guarantee of conformity applies independently of any commercial guarantee granted. 9.2 After-sales service

The products covered by the guarantees must be returned new, complete and in their original condition and packaging (or equivalent packaging) after receipt and confirmation of the claim by the after-sales service.
10. LIABILITY
In view of article L221-15 of the Consumer Code, the seller is bound by an obligation of result concerning the delivery of the product in good and due form and its use under normal conditions.
The Company cannot be held liable in the event of non-performance or poor performance of the contract due either to the act of the buyer, or to the insurmountable and unforeseeable fact of a third party to the contract, or to force majeure.
In addition, the product must be used in accordance with the description made on the site, in the event of misuse, use other than for the intended purposes, the customer will be responsible for the damage suffered and cannot in any way turn against livredeschallenges.fr
No regulations specific to the country of delivery and/or consultation of the website may be opposed to the Company.
11. APPLICABLE LAW
In the event of a dispute, the law applied will be that in force in the country where the registered office of our company is located. 12. DISPUTES
In the event of a dispute, the consumer and the seller must, before any legal proceedings, attempt to resolve their dispute by means of mediation.
13. COPYRIGHT ON THE CREATION OF PERSONALIZED PORTRAITS
All personalized portraits are the digital and copyright property of the company Livre Des Challenges, any reproduction is liable to prosecution.
When ordering, the user authorizes the company delivers challenges to use the personalized portrait production without the original photo for its commercial and communication media. However, if the user wishes to have his personalized portrait removed from commercial and/or communication media, he must let it be known by writing to the address contact@livredeschallenges.fr
